The Ministry of Justice is to undertake research into the impact of Litigants in Person cross-examining vulnerable witnesses in private law children cases. The President of the Family Division, Sir James Munby, has invited judges to co-operate with the research by reporting those cases where such questioning by Litigants in Person is, or threatens to be, an issue.

The research will cover a 3-month period beginning in March and will aim to establish the extent of any problems, and consequently what can be done to assist with managing these cases and ensuring vulnerable witnesses are protected.

The President’s full comments can be found here.
