Court of Protection

Chambers has several members with a wealth of experience in Court of Protection work, including issues surrounding property, finance, health and welfare.

Members of chambers are able to advise family members on the merits of applying for a Lasting Power of Attorney in cases of elderly relatives with degenerative diseases where they become incapable of managing their own financial affairs, or in the case of serious brain injury or other cases where it has not been possible to apply for an LPA, to assist in Deputyship applications.

Decisions may also need to made for relatives about their health and welfare, again where they may no longer have the mental capacity to make those decisions themselves. In the event someone needs to enter a care home, there may be questions about safeguarding and deprivation of liberty, issues about which New Court barristers are well qualified to advise.

Other Court of Protection matters include applications relating to medical interventions in respect of an individual unable to make those decisions, or against the wishes of their family members. Our barristers pride themselves on dealing with these cases professionally, humanely and sensitively. Chambers offers a breadth and depth of experience upon which clients can rely and aims to provide continuity of representation whenever possible.

In addition to their advisory work and court appearances, members of the team regularly present CPD and NPP accredited seminars to clients and charitable organisations.
